Abstract

International law imposes parallel but distinct obligations on states in relation to missing and disappeared persons: a duty to search and clarify their fate and whereabouts and return their remains to their families, and where the disappearance is connected to a crime such as an enforced disappearance, a war crime or a crime against humanity a duty to carry out a criminal investigation. The International Convention for the Protection of All Persons from Enforced Disappearance imposes a duty to coordinate the search and criminal investigation, yet in practice this coordination is difficult to achieve. In addition, the duty to prosecute requires states to investigate and prosecute violations of human rights and humanitarian law, in particular international crimes and other gross violations of human rights.

This paper examines how the duty to prosecute can shape the implementation of the duty to coordinate. It sets out the scope of the duty to prosecute and asks whether it places limitations on how states design coordination mechanisms. Drawing on the practice of existing missing persons mechanisms, the paper argues that states have significant freedom to design coordination mechanisms, provided they have a dedicated prosecuting authority that addresses past human rights violations, and a well-crafted prosecutorial strategy.

Dr Aruni Jayakody is a Lecturer in the School of Law at RMIT University, Australia. Her teaching and research focus on public international law, international human rights law and transitional justice. Aruni holds a Bachelor of Laws (Hons) and a Bachelor of Arts (Hons) from the University of Queensland, and a Master of Arts in Law and Diplomacy and PhD from The Fletcher School at Tufts University. Her doctoral research combined international law and international relations to explore why states commit to and comply with international human rights law, with a particular focus on Sri Lanka’s and Nepal’s engagement with the UN Human Rights Council (HRC) and OHCHR. Care and International Law: Rethinking Responsibility and Global Justice (ANZSIL GSIL Interest Group Workshop) (29 Oct 2026)

Theme

In this time of global uncertainty and crisis, resisting militarist, colonial, capitalist, ecocidal, and cisheteropatriarchal violences is an ongoing challenge. When faced with the intersecting violences of this current moment, placing care and care work at the core of international law narratives is a radical proposition. It is also a vital one. As scholars across international studies have shown(1), building upon the everyday care activism and practices of Indigenous, Black, decolonial, feminist, queer, socialist, and crip communities, care is what sustains relations and underpins international practices. For example, academics such as Roxani Krystalli and Philipp Schulz are disrupting peace and conflict studies by studying the resilience of care and love in times of conflict(2). But while questions of care, broadly understood, have been the subject of international legal scholarship, only recently are scholars articulating an explicit research agenda for ‘centring care in international law’(3). Inspired by Catherine O’Rourke’s work, such an agenda ‘aims to reshape international law, putting care, not just harm, at its heart’(4). Putting care at the centre of international legal thinking offers opportunities to examine the pervasive structural inequalities and inequities that operate beneath the narrative of harm, demonstrating that harm prevention does not equate to liberation.

Motivated by these provocations, this call asks: what is possible when we shift dominant narratives of international law and enliven alternative accounts which focus on the structures and imbalance that underpin them? This workshop will explore these questions by bringing together papers and reflections on themes including but not limited to:

Conceptual approaches to care and centring care in international law
The political economy of care, including but not limited to care and social reproduction, care labour, violence and carelessness in global supply chains and neoliberal capitalism
Care and international law beyond the human: post-human, other-than-human, more-than-human, multispecies, ecocentric, planetary, blue, and wild law approaches
Rewriting care into legal judgements, decisions, and processes
Prefigurative feminist legal projects and alternatives to justice and international law that centre care as a basis for lawmaking
Practices of care within the international legal profession and academy, including care in teaching international law
Practices of care, love, pleasure, and dignity in times of genocide, authoritarianism, and crisis
Queer and trans approaches to care, including queer kinship and care in international law
Care as forms of resistance, mutual aid, and survival, including from abolitionist and decolonial approaches
Caring and care-full methodologies for the study and practice of international law
The paternal and colonial violence of international law invoked through narratives of care
Care and health in international law, including women’s health and reproductive and sexual health rights
Indigenous ways of knowing, being, and doing care in and beyond international law
Care and disability justice in international law

Submissions

The Call for Papers has now closed.

Successful applicants will be expected to submit draft papers of between 6,000 and 8,000 words by 1 October 2026. Our aim is for the workshop to result in an edited collection or journal special issue. All papers will go to peer review prior to publication.

ANZSIL International Economic Law Interest Group Workshop

Call for Papers and Invitation to Participate

The ANZSIL International Economic Law Interest Group (IELIG) was established in 2011 to provide a forum for those interested in international economic law, especially international regulation of trade, investment, intellectual property, and monetary law. The work of the Interest Group covers all areas of international economic law and its implementation in domestic law, embracing both theoretical and practical aspects. The IELIG aims to maintain relevance for government, practitioners and academics alike and encourages discussion and exchange of ideas among all those involved in this field.

2026 Workshop (online)

The 2026 ANZSIL IELIG Workshop will be held via Zoom on Friday 27 November 2026. Its aim is to provide an informal setting for discussion of topical issues and works in progress.

We are honoured to have Professor Jarrod Hepburn, University of Melbourne, as this year’s keynote speaker. He will speak on ‘The Flexible Sources of Investment Law’. Jarrod received the ANZSIL Article Prize this year for ‘The Legal Justification for the Doctrine of Legitimate Expectations in International Investment Law’ (2025) 36 European Journal of International Law 43. As part of the workshop, we celebrate this achievement with panel on Jarrod’s work.

We invite paper proposals from ANZSIL members, practitioners in the field as well as staff from MFAT, DFAT, and the Attorney-General’s Department. We encourage PhD students, early career practitioners and academics to submit a proposal. Paper proposals may be on any topic within the work of the IELIG.

All speakers are invited to submit their paper following the workshop to the Australian Year Book of International Law or the New Zealand Yearbook of International Law for possible publication. We also invite ANZSIL members and MFAT/DFAT/AGD staff to attend the workshop even if not presenting a paper.

ANZSIL History and Theory of International Law Interest Group Workshop (10 Dec 2026)

The ANZSIL History and Theory of International Law Interest Group invites proposals to participate in its third biennial Workshop, to be held in person on Thursday 10 December 2026 at the University of Technology Sydney with an option for remote participation for those unable to travel.

Co-convened by Amanda Alexander, Wanshu Cong and Kathryn Greenman, the workshop will provide a collegial environment in which to get feedback on new research in history and theory of international law. Selected participants will be invited to submit work in progress of 2,000–6,000 words. Standard as well as non-standard research outputs are welcome provided that the work is at a stage where feedback might be meaningfully incorporated.

Researchers at all levels working with issues of history and theory of international law broadly understood are welcome to submit a proposal to participate. If the Workshop is oversubscribed, preference will be given to early and mid-career researchers working in Australia and New Zealand.

Invited participants will be asked to submit a draft by Monday 30 November 2026 to enable a final program and papers to be circulated in advance of the Workshop.
